Our litigation/ADR expertise varies from advice on conflict avoidance and pre-litigation strategic counseling to full litigation representation before judicial bodies. When appropriate, ADR techniques such as early neutral evaluation, executive tribunals, non-binding and binding expert opinion procedures, adjudication boards, mediation and conciliation are employed to achieve a cost-effective resolution.
When that is not possible, our team is well prepared to use more traditional litigation methods to achieve the desired results, and in all cases aggressively pursues and represents our clients’ interests. The lawyers of Conway & Partners have represented parties in complex disputes at both the trial court and appellate levels. This includes a wide breadth of experience representing parties in summary and expedited court procedures, which are particular to the Dutch jurisdiction, and are an effective means for achieving quick resolution of claims for monetary compensation. The types of disputes handled by Conway & Partners includes general trade disputes, construction and engineering claims, corporate and shareholder actions, as well as disputes between joint venture partners and claims arising out of banking transactions.
Given the international accent of our litigation practice, we are often involved in multi-jurisdictional litigation and in that regard are called upon to act as coordinating counsel to oversee the work of correspondent law firms representing clients in other jurisdictions in related matters. As we are a multi-lingual team which includes lawyers from both common and civil law jurisdictions, we are uniquely qualified in this respect in the Netherlands. Our attorneys have also acted for parties in multi-jurisdictional evidence gathering efforts, including actions taken before U.S. and Netherlands courts in support of litigation in other jurisdictions. Finally, our particular expertise in international arbitration means that our local litigation specialists are well placed to assist parties in the setting aside, and enforcement of arbitral awards. As litigators and arbitration specialists, we are well versed on the issues surrounding the international and domestic enforcement of awards.
