Industrial Projects
The industrial projects practice of Conway & Partners is built upon the long-standing relationship which our firm has with the construction and engineering industry. Our track record of assisting clients on some of the largest, (international) industrial projects sets Conway & Partners apart from other firms. We are called on by project owners, engineers, contractors, and suppliers, in all phases of their projects to assist with the legal structure needed to implement a project successfully.
We advise on all aspects of capital industrial projects in a wide range of industries including greenfield operations and major infrastructure projects. The locations of projects we have been involved on literally span the globe. We also have experience with a variety of standard contract forms from around the world and specialize in litigation/ADR in the construction industry.
Our legal assistance touches on all facets of industrial construction projects (eg. EPC, Turnkey) including preparing the agreements for basic engineering / architectural work or feasibility studies, preparing/reviewing/advising on tender documents as well as contract documentation (such as pre-bid agreements, project contracts, joint venture or consortium agreements, subcontracts and related letters of credit, bonds, guarantees, service and license agreements).
A cross-section of the types and locations of projects we typically assist on include:
- Refinery, petrochemical, pharmaceutical and related projects in Thailand, South Africa, Portugal, the Netherlands, and elsewhere in Europe.
- Power plants and waste incineration facilities (UK, USA, the Netherlands)
- Airport facility projects at Hong Kong, Charles de Gaulle, Heathrow, Gatwick, Oslo, Lebanon, Prague, Antalya (Turkey), Dubai, Beirut, and others.

- Distribution Centers for retail, mail order, parcel handling, courier, postal, apparel, electronics and other companies throughout Europe.
- Pipeline projects (primarily Middle East and North Africa).
- Telecommunications and electrification projects throughout all regions of the world, particularly in developing countries in Asia, South America and Africa.
- Dredging and hydrological engineering (Middle East, Asia, Africa), greenhouse-garden centers, (USA), and other miscellaneous projects.
A substantial portion of international projects use standard form agreements such as the various FIDIC conditions, the MF / 1 (U.K.), JCT (U.K.), AIA (U.S.), and United Nations forms as well as lesser-known local contract condition forms. We are, of course, quite familiar with such standard form contracts. More often, however, major projects are based on manuscripted agreements developed for the specific project or by the owner itself. There we bring our experience to bear, if needed, to achieve a balanced final contract. We also handle all sorts of variations on “Build-Operate-Transfer” and other forms of builder financing arrangements and “partnering” approaches (open book pricing with incentive fees) which the U.S. Army corps of Engineers pioneered in the United States.
Knowing what can possibly go wrong is a good thing when trying to avoid future problems.
