Waiving The Procedural Misconduct of Arbitral Tribunals

An arbitral award may be set aside if a tribunal breaches its mandate. If a party fails to raise the breach during the arbitral proceedings, however, it may be deemed to have waived its right to rely upon the error during a challenge to the award. A recent ruling of the Netherlands Supreme court sets limits on when this waiver may be considered.
